A continuación se detallan los términos y condiciones a los cuales usted, “el USUARIO” se compromete a cumplir y acepta en relación con el uso de la plataforma de reservas en línea de SEEKERS FALLS, así como los términos y condiciones de uso de las instalaciones de SEEKERS FALLS® y AWA MUSEO DEL AGUA

Al registrarse, acceder o utilizar de otra manera este sitio web, o bien mediante su compra del tiquete de entrada a AWA MUSEO DEL AGUA, el Usuario acepta estar sujeto a estos Términos y condiciones que se establecen a continuación. El mero uso de este sitio web implica el conocimiento y aceptación de estos Términos y condiciones:

1. Condiciones para hacer uso del Servicio en Línea:

• El Usuario hace constar que la compra ha sido realizada por una persona mayor de edad (18 años) con la capacidad legal de obligarse de forma vinculante.
• En caso de USUARIOS menores de edad, la compra ha sido realizada por un adulto responsable, quien acepta estos términos y condiciones en representación del menor.
• El USUARIO deberá completar toda la información de contacto de la persona que hará uso de las instalaciones del AWA MUSEO DEL AGUA . El USUARIO garantiza que la información es veraz y cierta
• Por su parte AWA MUSEO DEL AGUA garantiza que la información personal del USUARIO será utilizada solamente para los fines detallados en estos términos y condiciones
• El USUARIO se obliga a pagar el monto indicado en los medios oficiales para ingresar y hacer uso de las facilidades e instalaciones de AWA MUSEO DEL AGUA
• La tarifa de ingreso no incluye impuestos, los mismos serán agregados al momento del pago.
• Si el pago se genera desde el extranjero, su institución financiera puede imponer tarifas o cargos adicionales por transacciones internacionales.
• Política de Cancelación. AWA MUSEO DEL AGUA procederá a hacer un rembolso del importe cobrado solamente en caso de que la cancelación se haga al menos 48 horas antes de la fecha reservada. De lo contrario, AWA MUSEO DEL AGUA ofrecerá al Usuario la posibilidad de reprogramar su visita para otra fecha, que deberá ser dentro de los siguientes treinta días contados a partir de la fecha de la reserva inicial.
• AWA MUSEO DEL AGUA no es responsable de las fallas de comunicación, errores, dificultades u otros fallos de funcionamiento relacionadas con la prestación del servicio de internet, ni es responsable de transacciones, transmisiones, mensajes o entradas perdidos, robados o mal dirigidos en el Servicio o en relación con este en virtud de dichas fallas.
• AWA MUSEO DEL AGUA podrá comunicarse con el Usuario mediante correo electrónico, o mensajería vía whatsapp, utilizando la información provista por el Usuario al momento de su registro.

2. Condiciones para hacer uso de las instalaciones de AWA MUSEO DEL AGUA

• El USUARIO reconoce que al participar de las actividades y tours ubicados en AWA MUSEO DEL AWA pueden existir una serie de riesgos que admite como posibles y que pueden ocasionar lesiones físicas y emocionales los cuales son inherentes a la actividad y no se pueden eliminar, ni aun empleando la mayor diligencia. Estos riesgos incluyen: caídas, resbalones, raspones, moretones, esguinces, mareos, lesiones cervicales, ruptura de piernas o brazos y contusiones y otros no limitados en este documento.
• Se prohíbe el ingreso a las instalaciones bajo los efectos del alcohol o cualquier tipo de estupefacientes. AWA MUSEO DEL AGUA se reserva el derecho de admisión cuando su personal considere, a su criterio, que la persona no está apta para participar de la experiencia de AWA MUSEO DEL AGUA
• Asimismo, se prohíbe el consumo de bebidas alcohólicas y cualquier tipo de droga o sustancia estupefaciente durante la visita del Usuario a AWA MUSEO Del AGUA
• El Usuario reconoce que AWA MUSEO DEL AGUA se encuentra en el ambiente natural de Costa Rica en el cual abunda insectos, serpientes, pavos reales, ardillas, arañas y una variedad de otras especies de vida silvestre potencialmente peligrosos.
• AWA MUSEO Del AGUA tomará todas las precauciones y cuidados posibles para proteger a los usuarios del servicio dando los avisos correspondientes e informando a los Usuarios del estado de sus instalaciones y del clima. No obstante, el Usuario entiende y acepta que derrumbes, caída de piedras y crecidas de agua también son comunes, por lo tanto, AWA MUSEO Del AGUA no será responsable de los efectos que alguno de estos eventos cause en una determinada visita
• El Usuario se compromete a participar en las actividades, caminatas y/o tours solo si es médica, física y mentalmente capaz de hacerlo. En ese sentido, manifiesta que se encuentra en buena condición física sin cirugía reciente, padecimientos del corazón, asma, embarazo, u otra lesión o padecimiento, y que en caso de padecer alguna de estas condiciones, lo mismo deberá ser comunicado a los encargados de AWA MUSEO Del AGUA por escrito ya que esto implica un aumento en el riesgo de la actividad, y por ello, en caso de que algo suceda, el Usuario asumirá la responsabilidad total de los daños directos.
• Los menores de edad deberán estar acompañados de un adulto en todo momento durante su visita a AWA MUSEO DEL AGUA.

3. Liberación de Responsabilidad.
• El Usuario entiende y acepta que ha sido debidamente informado de los riesgos detallados en el punto anterior, así como de la imposibilidad de eliminarlos de forma absoluta, y reconoce que su participación e ingreso a AWA MUSEO Del AGUA es completa y absolutamente voluntaria.
• Por lo tanto, el Usuario manifiesta que en caso de que alguno de los riesgos antes detallados llegue a materializarse y producir un daño, el Usuario libera voluntaria y definitivamente a AWA MUSEO Del AGUA y su personal de responsabilidad civil, penal y administrativa, comprometiéndose a mantener a la operación libre de reclamos, causas o acción.
• Con la aceptación de estos Términos y Condiciones, el Usuario acepta asumir todos y cada uno de los riesgos o responsabilidades que puedan surgir de su visita a AWA MUSEO Del AGUA y acepto defender, indemnizar y eximir de toda responsabilidad a AWA MUSEO Del AGUA sus colaboradores, personal, y accionistas de y contra todas y cada una de las responsabilidades, reclamos, demandas, gastos y costos (incluidos, entre otros, los honorarios razonables de abogados externos) que surjan de dicha participación en las actividades descritas en este documento.
• El Usuario libera a AWA MUSEO Del AGUA de cualquier reclamo, controversia, acción, causa de acción, contrademanda, reconvención, demanda, deuda, daños compensatorios, daños liquidados, daños punitivos o ejemplares, otros daños, reclamos por costos y honorarios de abogados, o responsabilidades de cualquier naturaleza en derecho y equidad, pasadas, presentes y futuras que surjan de su visita a AWA MUSEO Del AGUA.

4. Disposiciones Adicionales
• Derechos de Imagen. El Usuario otorga expresamente a AWA MUSEO Del AGUA una licencia gratuita universal y perpetua para fotografiar y reproducir su imagen, semejanza y voz (ya sea en una cámara fija o en movimiento) únicamente derivada de la visita del Usuario a AWA MUSEO Del AGUA y el uso de sus instalaciones y tours, ya sea en materiales de marketing, anuncios, uso en el sitio web de AWA MUSEO Del AGUA así como en sus redes sociales.
• Fuerza mayor. Excepto por las obligaciones de pago de dinero en virtud del presente, ninguna demora, incumplimiento u omisión por parte de cualquiera de las partes para llevar a cabo u observar cualquiera de sus obligaciones en virtud del presente se considerará un incumplimiento de estos Términos y condiciones si y durante el tiempo que dicha demora, incumplimiento o omisión surge de cualquier causa más allá del control razonable de esa parte.
• Actualización de estos Términos y condiciones. Es posible que actualicemos estos Términos y condiciones de tiempo en tiempo. Cualquier actualización será debidamente comunicada y reflejada en la página web de AWA MUSEO Del AGUA La fecha provista al pie de estos Términos y Condiciones es la última fecha de revisión. Los cambios a estos Términos y condiciones entrarán en vigencia una vez que dichos cambios se publiquen en este sitio web. Su uso continuado de este sitio web después de la publicación de cambios o actualizaciones se considerará una notificación de su aceptación de cumplir y estar sujeto a estos Términos y condiciones.

Terms and Conditions (English)

Following are the Terms and conditions to which you, "the USER" agree to comply and accept related to the use of the SEEKERS FALLS online reservation platform, as well as the terms and conditions of use of the facilities of SEEKERS FALLS® and AWA MUSEO DEL AGUA hereinafter “AWA MUSEO DEL AGUA”
By registering, accessing or otherwise using this website, and/or by purchasing the entrance ticket to AWA MUSEO DEL AGUA, the User agrees to be bound by these Terms and Conditions set forth below. The mere use of this website implies knowledge and acceptance of these Terms and Conditions:
1. Terms of Use for the Online Service:
•The USER hereby declares that the purchase has been made by a person of legal age (18 years) with the legal capacity to act in a binding manner.
• For underage USERS, the purchase has been made by a responsible adult, who accepts these terms and conditions on behalf of the minor (under the age of 18).
• The USER must include all the contact information of the person who will use the facilities of the AWA MUSEO DEL AGUA. The USER guarantees that the information is true and true
• AWA MUSEO DEL AGUA guarantees that the USER´s personal information will be used only for the purposes detailed in these Terms and Conditions.

Otherwise, AWA MUSEO DEL AGUA will offer the User the possibility of rescheduling their visit for another date, which must be within the following thirty days from the date of the initial reservation.
• AWA MUSEO DEL AGUA is not responsible for communication failures, errors, difficulties, or other malfunctions related to the provision of the internet service, nor is it responsible for lost, stolen or misdirected transactions, transmissions, messages or entries in the Service or in connection with it by virtue of said failures.
• AWA MUSEO DEL AGUA may communicate with the User via email, whatsapp direct messaging, by using the information provided by the User at the time of registration.
2. Terms of use. AWA MUSEO DEL AGUA facilities
• The USER acknowledges that participating in the activities and tours within AWA MUSEUM could imply a series of risks that User recognizes as possible and that may cause physical and emotional injuries which are inherent to the activity and cannot be eliminated, even using the greater diligence. These risks include: falls, slips, scrapes, bruises, sprains, dizziness, cervical injuries, broken legs or arms and bruises and others not detailed in this document.
• Entering the facilities under the influence of alcohol or any type of narcotic is prohibited. AWA MUSEO DEL AGUA reserves the right of admission whenever its staff considers, at its discretion, that a person is not suitable to participate in the AWA MUSEO DEL AGUA experience.
• Likewise, the consumption of alcoholic beverages and any type of drug or narcotic substance is prohibited during the User's visit to AWA MUSEO DEL AGUA.
• The User acknowledges that AWA MUSEO DEL AGUA is located in the natural environment of Costa Rica in which insects, snakes, peacocks, squirrels, spiders and a variety of other potentially dangerous wildlife species abound.
• AWA MUSEO Del AGUA will take all the possible precautions and care actions to protect the users of the service, giving the appropriate notices and informing the Users of the state of its facilities and the weather. However, the User understands and accepts that landslides, falling stones and flooding are also common, therefore, AWA MUSEO Del AGUA will not be responsible for the effects that any of these events cause in any given visit.
• The User agrees to participate in the activities, tours, and or hikes only if he is medically, physically and mentally capable of doing so. The USER states that they are in good physical condition without recent surgery, heart disease, asthma, pregnancy, or other injury or illness, and that if USER suffers from any of these conditions, this must be informed in writing to AWA MUSEO DEL AGUA and its staff since this implies an increase in the risk of the activity. Nonetheless, in the event something happens, the User will assume full responsibility for direct damages.
• Minors under the age of 18 must be accompanied by an adult at all times during their visit to AWA MUSEO DEL AGUA.
3. Limitation of Liability.
• User understands and accepts that they have been duly informed of the risks detailed in the previous section, as well as the impossibility of completely eliminating any and all risks related to the visit, and acknowledges that their participation and admission to AWA MUSEO Del AGUA is completely and absolutely voluntary.
• Therefore, User declares that in the event that any of the risks detailed above materialize and cause any damage, the User voluntarily and definitively releases AWA MUSEO Del AGUA its shareholders and staff from civil, criminal and administrative liability, undertaking to keep the operation free of claims, causes or action.
• With the acceptance of these Terms and Conditions, the User agrees to assume each and every one of the risks or responsibilities that may arise from their visit to AWA MUSEO Del AGUA and agrees to defend, indemnify and hold AWA MUSEO Del AGUA its employees, staff, and shareholders harmless from and against any and all liabilities, claims, demands, expenses, and costs (including, without limitation, reasonable outside attorneys' fees) arising from such participation in the activities described herein.
• The User releases AWA MUSEO DEL AGUA from any claim, controversy, action, cause of action, counterclaim, counterclaim, demand, debt, compensatory damages, liquidated damages, punitive or exemplary damages, other damages, claims for costs and attorneys' fees, or liabilities of any nature in law and equity, past, present and future that arise from your visit to AWA MUSEO Del AGUA.
4. Additional Provisions
• Image rights. • Force Majeure. Except for obligations to pay money hereunder, no delay, failure or omission by either party to perform or observe any of its obligations hereunder shall be deemed a breach of these Terms and Conditions if and for as long as such delay, failure to perform or omission arises from any cause beyond that party's reasonable control.
• Terms and Conditions Update. We may update these Terms and Conditions from time to time. Any update will be duly communicated and reflected on the AWA MUSEO DEL AGUA website. The date provided at the bottom of these Terms and Conditions is the last revision date. Changes to these Terms and Conditions will be effective once such changes are posted on this website. Your continued use of this website following the posting of changes or updates will be deemed notification of your agreement to comply with and be bound by these Terms and Conditions.
